10/12/09 22:04:34	Tags : None Can you believe the justice system in this country .... 18 months ago my brother was beaten by 3 men whom were bouncers in a club.. they beat him into a coma, fracturing his skull leaving 2 blood clots to the brain they smahed his shoulder socket and blacked his eye. He was in a coma for a week and almost died ..........he has had extensive surgerys and his recovery has been long and difficult. He is only 41 years old and can barely move his arm coz of shoulder damage and has a titanium plate in his head coz they had to remove part of his skull... after a 2 week court case the men that did it just got off scott free NOT GUILTY ON ALL CHARGES!!!! its just unbelievable to me that this could happen.............If you could see the damaged they caused..............................cant believe it !!!!!!!!! and to know for sure they are lying makes it worse!! OK RANT OVER

10/12/09 22:15:51	That's dreadful news, Maddy. Hopefully in time he will recover. The human body is capable of great things but the psychological scars are far more reaching and the judicial system does not help but hinder. How comes they were found not guilty? On what grounds? Was this a Trial by jury? Our legal system has nothing to do with truth or justice. Defendants have more rights than the plaintiff. I wish your Brother well and your family. xx

Yes Wendy it was trial by jury ........Not sure of all the details... as my brother is too distressed to talk to anyone last night and I tried today and he is not picking up his phone... this has been a terrible 18 months for him and my family.. my brother had to move in with me and my family for a year and I aided his recovery... it was a terrible strain for him and me strugglin thru his pain, fainting, fitting, just scarey.. he now has himself and little council flat in London... I think there had to be vertually 100% sure re a guility verdict..... they had video evidence of the men grabbing him forcably and taking him to a part of the club with no cctv to beat him.....they beat him unconscience and thru him down stairs fracturing his skull and smashing his shoulder.... then just for fun went down stairs after him and gave him a kicking whilst his son and friend ran down to pleade with them to stop...... his son was with him and both there girlfriends and a friend. You can see there reactions on cctv to whats happening to him just off camera.... the brief did not let any of brothers injury pics be shown ... he was in a terrible state... anyway I guess we just have to all let it go and try and move forward from it ... but it makes me feel sick to think those MEN !! if thats what you call em, are walking free.... one of them already was on a simular charge (but that was not allowed to be used in court) and another man has done a runner and police could not even find him for court case .... He will need counselling because l fear the worst is yet to come, psychologically speaking. You cannot counsel him yourself, only be there. 10/13/09 20:30:35	mads, the picture becomes even grimmer, if that were possible, with your second post. the heart breaks. i second wendy's thoughts. the one bright light in all of this is that your brother has a strong and dedicated family who have gathered around to help him in every way it has been possible to do. the legal system has let him down to an extent which boggles the mind. his help must now come from elsewhere. i wish him well.

This makes one think that who and what can you trust anymore these days. I wish all the best for you and your brother. I hope you can complain to even higher court level. *** May I rant as well. A friend of a friend went to a hospital in the town I too used to live in, because of the chest pains she's been having. The doctor "kindly" suggested that he could also check her breasts in case of cancer and she agreed. The doctor rubed her breasts from front and back, complimented her about the size and shape of the breasts and ended up sucking her nipples. She sued the doctor and found that she wasn't the only one he had molested. There were others before and after her. The doctor admited that he had rubed and sucked her breasts, but the act wasn't sexual. He wanted to test if there was any abnormal fluits. But what makes me and so many others upset is that THE COURT BOUGHT IT and the doctor got off. The victim complainted to higher court level and she even had new evidence from the hospital: there were many similar complaints about the particular doctor. The court believed the doctor again! Again! In what can you trust these days if you are mistreated?! You are molested by a person you should be able to trust your most intimate pains with and not only that he get to keep his job and do it to others, in court he can tell what ever stories about pink elephants and gets away with it. Are they in same Freemason's loft or something? Or the judges in both courts enjoyed their bribes much.

I don't know where this happened but I would have thought that a doctor who did that in Britain would find himself off the Medical Register in no time at all. There can never be any reason for a doctor to do that as any doctor would testify and any judge knows all too well. Again, one wonders what the lawyers are being paid to do. Having said that and I'm sure this doesn't relate to this particular case, all doctors are vulnerable unless they have an chaperon present when they examine a patient which they are supposed to do. All too often that is impossible. Legally one is supposed to ask any patient one is going to examine whether they would like someone else in the room. If all patients said yes, say in a busy GP's practice, it would probably be impossible to implement because there wouldn't be the spare staff available. If a patient makes a complaint and the doctor didn't ask her if she wished someone to be present and who is to prove that without a witness, the patient will usually be given the benefit of the doubt. This makes male doctors in particular very vulnerable. So it cuts both ways. In your friend's case the doctor admitted sucking her breast but made an excuse that no imbecile should have believed. 09/03/81 19:55:47	Jurors are much more likely to believe a professional than us lesser mortals. Courts like proof. It is a doctors' word against a patient. Generally speaking, the medical profession close ranks. A Surgeon is forewarned he is about to be sued and is able to destroy evidence, and cover his tracks. In Britain, a nurse should be present whilst a Dr carries out intimate examinations. Certainly, a woman has the right to ask for a nurse. I guess, in part, it is about who has the best legal team but there is so much more to it. None of it fair or just. It's all about technicalities and legal loopholes. Always the Defendant has the legal advantage, whether it be a criminal case or civil. Thankfully, there are exceptions to the rule.

10/13/09 23:49:17	Absolutely not. But you are right that the defendant is in a strong position because guilt has to be proved beyond all reasonable doubt. Unfortunately if that isn't possible and the defendant is acquitted, the assumption is that he/she has been proved to be innocent beyond all reasonable doubt which isn't necessarily true. That is why there is a ludicrous 4% success rate for convictions in rape trials and only about 50% of reported rape cases get to Court because the evidence isn't considered strong enough. How often does one hear someone say, "She falsely accused a man of rape but he was acquitted", or, "He was falsely accused of rape." The victim is branded a liar because the jury didn't think the evidence was so 100% certain that they wanted to run any risk of convicting someone who might just be innocent. 10/14/09 00:31:42	Rape is notoriously difficult to prove as you say. I understand why women don't come forward. The law is not on the vistim's side. It is perfectly legal for the Defense to do a character assassination of the plaintiff. Make it look like she 'deserved it' and you have the Jury on side, that is a classic strategy used by a defense lawyer in any case, not just rape.

10/14/09 11:09:05	The other issue with rape is that the jury cannot be told the defendant's history. As you say, they can rake up the victim's past. He might be out on parole for a previous conviction or the Court may have seen the same man appear before them time and time again accused of rape by different women and been acquitted. Only the jury doesn't know that. It is fair to judge each case on its merits and not assume that if someone was guilty in the past they must also be this time but the jury can't really make a safe decision if they are not in possession of all the facts.

I just wish him,you and the whole family lots of strength to get through this. Meriah, this is an appalling story and unfortunately, as fruitcake said, an all too familiar one. It is the sort of thing which should be reported by the media more often. Perhaps it would encourage "victims" to come forward and complain and maybe give them the feeling that they are not alone. Rant as much as you like, ladies. I am sure everyone here has an open ear for these problems.
