I totally agree with you Caz .....
I have no anger in me as I feel it is soooo negative and eats you up inside ... I have learnt to deal with that in my life coz I have had issues around anger (not my anger but others towards me) I have learnt to deal with it xxxxxxxxxxx positive energy !!

To EVERYONE thank you all your words have been kind intersting and at times disturbing reading others and their stories ...

My brother (whom I have spoken to ) is now staying with his friend.... for a few days .. and is thinking legally about taking more action against these men.. but we will see coz sadly money is a prob xx

Injustice unfortunately happens to all of us every day in our daily activities somewhere down the line Tenor. An injustice here and there, 'where did that come from'........I very often find myself having to count to ten and breathe deeply about something that would have normally incensed me greatly in the past.
Discount it and throw it to the wind.

Very often people are looking for a reaction to something they have done to you.................and when the unexpected happens..............and they get no reaction at all, it completely floors them. Then they wonder what you're thinking.
Provocation that doesn't work is only wasting their energy. If you react they feel a sense of achievement, and then you are wasting your energy by acknowledging it.

It does take a great inner strength to remain silent. Cast aside a negative force trying to eat you up.............it will devour itself in it's own anger that it cannot touch you, or get...

I love your words on this, Caz. But also how I hope that it is true. It gets really very confusing sometimes, and more often than not, these things, though i have always tried so hard to stand by it, justice does not serve. Sometimes you get so fruastrated and indignant about it, and fruastrated and upset because you just can't seem to do anything about it. I liken it to almost being a living punchbag, if you get my point. But however hard, i'm still trying my utmost best to believe that there's still some justice in the world we live in... There's still consequences for things people do right or wrong.
Perhaps, In time... Just, in time...
Maybe not my time. But maybe it will come...
I don't know.
I can only hope, so as the rest of the world.

Maddy I'm really sorry to hear this news. Sending healing thoughts to your brother. He is obviously surrounded by a very caring family structure, and is going to need much, love, care and attention, as well as understanding for his future well being and problems that will undoubtedly surface following this dreadful act of violence.

It is quite unbelieveable that such things are allowed to get through the so called 'justice for all' system.

Whilst it is to late ............the deed has been done...........has your family considered talking to him about taking legal advice to bring a Civil Action against the men concerned (assuming they are still around) and if they did, would the outcome be favourable. No point throwing good money after bad influences. But on the other hand.........'for evil to suceed, good men need do nothing'.

May I rant as well. A friend of a friend went to a hospital in the town I too used to live in, because of the chest pains she's been having. The doctor "kindly" suggested that he could also check her breasts in case of cancer and she agreed. The doctor rubed her breasts from front and back, complimented her about the size and shape of the breasts and ended up sucking her nipples.

Maddy! Oh my god!!! I hate these kind of things!!! UGH!! I use to read these stories of injustice back when i was younger, and would feel so indignant about it. Unfortunately, these things happen all the time as much as how much we hate for it to... I am really very sorry to hear about your brother. wish i could do something to help. I am so shocked, yet not entirely shocked by your brother's story. We read and hear news about this on the papers ever so often. These real life stories are so shockingly disgusting, extremely painful to hear, yet true... and can happen and is perhaps happening to the people whom we least expect sometimes.

Meriah, what happened to your friend makes me feel sick. The fact that his disgusting behavior went unpunished, I think, is the worst part. I didn't know about having a nurse present during exams until last year, and now I have one. (I got a new doctor and it is his policy I guess).
Has anyone seen Jodi Foster in The Brave One? I was yelling out KILL HIM at the end, so unlike me. I can see how one would wish to take matters into their own hands at times.

Maddy, I'm so sorry about your brother. Everything I would say has already been said. I just wish him,you and the whole family lots of strength to get through this.
Meriah, this is an appalling story and unfortunately, as fruitcake said, an all too familiar one. It is the sort of thing which should be reported by the media more often. Perhaps it would encourage "victims" to come forward and complain and maybe give them the feeling that they are not alone.

Rant as much as you like, ladies. I am sure everyone here has an open ear for these problems.

The other issue with rape is that the jury cannot be told the defendant's history. As you say, they can rake up the victim's past.
He might be out on parole for a previous conviction or the Court may have seen the same man appear before them time and time again accused of rape by different women and been acquitted. Only the jury doesn't know that.
It is fair to judge each case on its merits and not assume that if someone was guilty in the past they must also be this time but the jury can't really make a safe decision if they are not in possession of all the facts.

Rape is notoriously difficult to prove as you say. I understand why women don't come forward. The law is not on the vistim's side. It is perfectly legal for the Defense to do a character assassination of the plaintiff. Make it look like she 'deserved it' and you have the Jury on side, that is a classic strategy used by a defense lawyer in any case, not just rape.

Absolutely not.
But you are right that the defendant is in a strong position because guilt has to be proved beyond all reasonable doubt. Unfortunately if that isn't possible and the defendant is acquitted, the assumption is that he/she has been proved to be innocent beyond all reasonable doubt which isn't necessarily true.

That is why there is a ludicrous 4% success rate for convictions in rape trials and only about 50% of reported rape cases get to Court because the evidence isn't considered strong enough.

How often does one hear someone say, "She falsely accused a man of rape but he was acquitted", or, "He was falsely accused of rape." The victim is branded a liar because the jury didn't think the evidence was so 100% certain that they wanted to run any risk of convicting someone who might just be innocent. That...

Jurors are much more likely to believe a professional than us lesser mortals. Courts like proof. It is a doctors' word against a patient. Generally speaking, the medical profession close ranks. A Surgeon is forewarned he is about to be sued and is able to destroy evidence, and cover his tracks.

In Britain, a nurse should be present whilst a Dr carries out intimate examinations. Certainly, a woman has the right to ask for a nurse.

I guess, in part, it is about who has the best legal team but there is so much more to it. None of it fair or just. It's all about technicalities and legal loopholes. Always the Defendant has the legal advantage, whether it be a criminal case or civil.

Thankfully, there are exceptions to the rule.

Agreed Mariah, that is another miscarriage of justice. I don't know where this happened but I would have thought that a doctor who did that in Britain would find himself off the Medical Register in no time at all. There can never be any reason for a doctor to do that as any doctor would testify and any judge knows all too well.
Again, one wonders what the lawyers are being paid to do.

Having said that and I'm sure this doesn't relate to this particular case, all doctors are vulnerable unless they have an chaperon present when they examine a patient which they are supposed to do. All too often that is impossible. Legally one is supposed to ask any patient one is going to examine whether they would like someone else in the room. If all patients said yes, say in a busy GP's practice, it would probably be impossible to implement because there wouldn't be the spare staff available.
If a patient makes a complaint and the doctor didn't ask...

Can you believe the justice system in this country ....
18 months ago my brother was beaten by 3 men whom were bouncers in a club..
they beat him into a coma, fracturing his skull leaving 2 blood clots to the brain
they smahed his shoulder socket and blacked his eye. He was in a coma for a week and almost died ..........he has had extensive surgerys and his recovery has been long and difficult. He is only 41 years old and can barely move his arm coz of shoulder damage and has a titanium plate in his head coz they had to remove part of his skull...
after a 2 week court case the men that did it just got off scott free NOT GUILTY ON ALL CHARGES!!!! its just unbelievable to me that this could happen.............If you could see the damaged they caused..............................cant believe it !!!!!!!!! and to know for sure they are lying makes it worse!!...
